Terms of Service

Backup-Spot maintains the interactive portion(s) of the Web site as a service free of charge. By using any interactive or paid services provided herein, you are agreeing to comply with and be bound by the terms, conditions and notices relating to its use.

Modification to the Terms of Service

Backup-Spot reserves the right to change the Terms at any time. The modified Terms will be effective immediately upon change. You automatically agree to these Terms by continuing the use of Backup-Spot services. We will send a notice to every customer who has an active account with us after the modification was made.

Reselling Services

Reselling is only allowed on any Reselling package. Unless it's described that you are allowed to resell or you have an written permisson from Backup-Spot, allowing you to resell our services, you do not have the right to resell any services provided by Backup-Spot.

Service Refusal

Backup-Spot reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with notice. We reserve the right to refuse service to anyone without any reason at any given time with notice.

Service Usage

The customer agrees to use any backup space provided by us solely to store backups. File Sharing, malicious or illegal content is strictly forbidden and will lead to Service Refusal / Termination. Every customer is entitled to use as much data transfer as they want, the only limitation in place is the 1GBps port.

Violation of the Terms

Any Violation of the Terms of Service will waive the refund policy and will lead to immediate termination of any Backup-Spot services without notice.

Payments

Services will be suspended if payment is not received on the due date. If the account still has an negative balance, 14 days after the due date, the service will be terminated.

Chargebacks

Any Chargeback will lead to immediate suspension of the customers account and a fee of $5 USD for administration.

ALL SERVICES PROVIDED BY BACKUP-SPOT ARE PROVIDED "AS IS". IN NO EVENT SHALL BACKUP-SPOT OR ITS EMPLOYEES, OFFICERS, DIRECTORS, CONTRACTORS, OR ASSOCIATES, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THESE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
